ผม ถามอะไรนิดได้มั้ยครับ คือสงสัยหน่อย จะเรียกข้องใจก็ได้ ที่โดนๆแบนกัน นอกเหนือจาก เจ้าของกระทู้เนี่ย ค่าคอม นี่ได้กันประมาณเท่าไรครับ

ว่าแต่ถ้าเป็นเวปเราเองแล้วใส่คำว่า We associated with Amazon.com  ตรง footer จะโดนไหม แต่ก่อนหน้านี้ก็ใส่มาตลอด 3 ปีที่ทำอะเมซอนนะ และรูปนี้จะโดนไหมอะ ลองเมล์ไปถามมันแล้วแต่ยังไม่ตอบ

ผมลองเข้าไปอ่านกฎมันดู  เลยอยากสรุปตามที่เข้าใจนะครับ เฉพาะเรื่อง trademarks

ถ้าผิดก็ช่วยแก้ให้ด้วยล่ะกัน  แต่ผมเข้าใจของผมอย่างนี้ครับ
1) ที่สงสัยว่ารูปไหนจะโดนบ้าง  ให้พิจารณาอย่างนี้ครับ
ถ้าเป็นรูปที่เขาสร้างมาให้ associate ใช้ =>  ใช้ได้ 100%

2) ถ้าเป็นโลโก้ amazon หรือ logo endless หรือ...  ต้องมีคำบอกลิขสิทธิ์ ครับ

จริงๆ เมื่ออ่านข้อนี้แล้ว  การที่เรามีโลโก้อเมซอนก็ไม่น่าผิดครับ  แต่เราผิดที่เราไม่มีคำระบุสิทธิ์ ที่แสดงให้เห็นชัดเจนครับ

3) ถ้ารูปนั้นคุณโมดิฟายด์  หรือสร้างเอง  อันนี้ขึ้นอยู่ที่คำตัดสินของอเมซอนอย่างเดียว(ห้ามอุทธรณ์ครับ) ว่าได้ทำให้ภาพลักษณ์เขาเสียหายไหม

น่าจะระดับหมื่นเหรียน ไปนะเอก เพราะเสี่ยคนที่เรารู้จัก ตกใจมากเมื่อวานโทรมาบอกว่าโดน งงกันไปเลย คุยกันๆ ตอนแรกคิดว่าเป็นที่ API กับ Track ID ไม่ตรงกับ ACC แต่วันนี้ยังไม่เห็นออนเอ็มเลยม่ะทราบความคืบหน้า เพราะเสี่ย แกบอกจะโทรไปคุยอ่ะ 

ว่าแต่ถ้าเป็นเวปเราเองแล้วใส่คำว่า We associated with Amazon.com  ตรง footer จะโดนไหม แต่ก่อนหน้านี้ก็ใส่มาตลอด 3 ปีที่ทำอะเมซอนนะ และรูปนี้จะโดนไหมอะ ลองเมล์ไปถามมันแล้วแต่ยังไม่ตอบ

ยอมรับว่าไม่เคยอ่านกฎเลย  กระทู้นี้เป็นกระทู้ที่ให้อ่านกฎจนหมด
ผมลองเข้าไปอ่านกฎมันดู  เลยอยากสรุปตามที่เข้าใจนะครับ เฉพาะเรื่อง trademarks

ถ้าผิดก็ช่วยแก้ให้ด้วยล่ะกัน  แต่ผมเข้าใจของผมอย่างนี้ครับ
1) ที่สงสัยว่ารูปไหนจะโดนบ้าง  ให้พิจารณาอย่างนี้ครับ
ถ้าเป็นรูปที่เขาสร้างมาให้ associate ใช้ =>  ใช้ได้ 100%

2) ถ้าเป็นโลโก้ amazon หรือ logo endless หรือ...  ต้องมีคำบอกลิขสิทธิ์ ครับ
You must prominently include a statement on your site stating that Amazon and the Amazon logo, Endless and the Endless logo, SmallParts and the SmallParts logo, and MYHABIT and the MYHABIT logo (as applicable) are trademarks of Amazon.com, Inc. or its affiliates. จริงๆ เมื่ออ่านข้อนี้แล้ว  การที่เรามีโลโก้อเมซอนก็ไม่น่าผิดครับ  แต่เราผิดที่เราไม่มีคำระบุสิทธิ์ ที่แสดงให้เห็นชัดเจนครับ

3) ถ้ารูปนั้นคุณโมดิฟายด์  หรือสร้างเอง  อันนี้ขึ้นอยู่ที่คำตัดสินของอเมซอนอย่างเดียว(ห้ามอุทธรณ์ครับ) ว่าได้ทำให้ภาพลักษณ์เขาเสียหายไหม

ทั้งสามข้อนี้คัดมาจาก 6 ข้อของเรื่อง Trademark Guidelines ครับ  ซึ่งมีระบุว่า
Strict compliance with these Guidelines is required at all times, and any use of an Amazon Mark in violation of these Guidelines will automatically terminate any license related to your use of the Amazon Marks.

มันแรงก็ตรงที่ถ้าคุณผิดเรื่อง trademark เข้า auto terminate เลยครับ
