It has come to our attention that you registered and have been using the domain name philipsxxxxxxxxxxxxxx.com.
Please be advised that Philips is the owner of the trademarks ‘Philips’ and ‘Sonicare’ in various countries worldwide. Philips is a world leader in among other consumer lifestyle products. Our company has made substantial investments in developing and implementing our trademarks worldwide. As a result our trademarks are widely known among the consuming public worldwide, and embody substantial and valuable goodwill. Protecting our valuable trademarks we monitor domain names and websites to verify that no confusion with our trademarks as to the source, affiliation, or endorsement of the websites, products and services is created.
As such, we noted that you registered and are using the domain name philipsxxxxxxxxxxxxxx.com. On the connected website we find a health care site, offering for sale Sonicare toothbrushes, but also other products of Philips and competitors (e.g. Braun, Gillette, Oral-B, Panasonic and Remington).
We believe that our trademarks are used in a way, which creates the mistaken belief among average consumers that you are somehow associated with our company, or that that our rights in the name 'Philips' and our trademarks are infringed upon, diluted or harmed in any other way, according to the applicable intellectual property legislations.
For this reason and in order to safeguard our rights in our trademarks, we request you and as far as needed urge you to confirm that you will:
· Cease and desist from using our trademarks in an unauthorized or inappropriate way;
· And discontinue use of the domain name comprising our trademark or variations thereof.
Please confirm your understanding and commitment to the above by signing this letter and returning it to us by fax and confirmation mail before February 1, 2010. In the absence of a favorable response to this letter, we will take appropriate actions to protect our rights in our trademarks. However, we must assure you that it is not the policy of Philips to enter into any proceedings, or otherwise, and it is our intention to deal with this matter in an amicable fashion. We may settle this matter amicably by transferring the domain name registration to Philips.
Please note that if you have a contractual relation with our company (or received prior written approval from Philips indeed), we appreciate if you can send us the details thereto.
