As you are probably aware, Sealed Air Corporation (“Sealed Air”) has adopted and used the trademark BUBBLE WRAP® in connection with its air cellular cushioning packaging products for over thirty-five years. The mark was first registered on the Principal Register in the United States Patent and Trademark Office in 1983 and has become incontestable. It is also registered in other Trademark Offices throughout the world. The BUBBLE WRAP® trademark is a valuable and important asset of Sealed Air.
We value our business relationship and appreciate that you are aiding us in the sale and distribution of our BUBBLE WRAP® branded products, however, we are sending this letter to ask that you use our trademark in a proper manner.
Please note that the BUBBLE WRAP® trademark should be used as follows:
• Only when referring to air cellular packaging material produced by Sealed Air;
• In the format of “BUBBLE WRAP” or “Bubble Wrap”, with the inclusion of the ® trademark notice together with the following legend: BUBBLE WRAP® is a registered trademark of Sealed Air Corporation (US); and
• As an adjective modifying a generic reference such as “products”, “air cellular material”, “cushioning material” or “packaging material”.
Therefore, we ask that you use the BUBBLE WRAP® trademark only as noted above and that you make the appropriate modifications to your website, advertisements and all marketing materials in connection with those products.
